Does both agents in failover pair suppose to create backups irregardless of state?
I have three failover pairs in a cluster, one of them I just added recently. The first two failover pairs are creating backup irregardless of who is online or offline. When I added the third pair and scheduled the backup, I observed that only the online agent is creating the backup (I have not tried to switch to the offline agent).

I would expect that only the active agent creates backups. Can you double-check that the backups on the inactive were created recently? Maybe these backups are there from when it was active?
I would raise this as an issue under Maintenance and Support. If you want to look a bit further yourself, you can look at the failover configuration in the DMS.xml (C:Skyline DataMiner) on both agents and have a look at what the SLFailover.txt log file (C:Skyline DataMinerLogging) tells you.

The backups on the inactive agents are being created at the same time with the active agents.
